These Terms of Service (the “Terms”) govern access to www.lianne-del.com (the “Website”) and purchases made from Ether Beauty SA, trading under the Lianne Del brand (“Ether Beauty”, “Lianne Del”, “we”, “us” or “our”). By using the Website or placing an order, you agree to these Terms. Mandatory consumer rights applicable in your country remain unaffected.

2. Eligibility and permitted use

You must have legal capacity to enter into a binding contract. If you are under the age of majority in your country, you may use the Website and place an order only with the involvement and consent of a parent or legal guardian. You may not use the Website or our products for unlawful, fraudulent or unauthorised purposes, interfere with the Website, introduce malicious code, scrape content without permission, or infringe our or any third party’s rights.

3. Products and product information

We take reasonable care to present our products, ingredients, sizes, packaging and colours accurately. Screen settings, packaging updates and lawful formula improvements may cause minor differences. Product photographs are illustrative and are not contractually binding where differences are immaterial. Always read the product label, ingredient list, directions and warnings supplied with the product before use. If you have allergies or sensitivities, check the current ingredient list before purchase and use.

Our cosmetic products are intended for external use and normal personal care. Information on the Website is general information and is not medical advice. Stop use if irritation occurs and seek appropriate professional advice when necessary. Nothing in these Terms excludes liability for a defective or unsafe product where exclusion is prohibited by law.

4. Prices, taxes and currencies

Prices displayed at checkout are the prices payable for the products and will state whether applicable taxes are included. Prices are shown in EUR unless the Website displays another currency for your market. Delivery charges, if any, are shown separately before the order is confirmed. For cross-border deliveries, import duties, customs charges or local taxes may be payable unless checkout expressly states that they are included. The customer is responsible for charges lawfully imposed by the destination country when they are not collected at checkout.

We may change prices at any time, but a change will not affect an order already accepted. If an obvious pricing or description error occurs, we may refuse or cancel the affected order and refund any amount paid.

5. Orders and formation of the contract

1. Select the products and quantities, provide accurate billing and delivery information, and review the order before payment.
2. The order acknowledgement confirms receipt of your request; it does not necessarily constitute acceptance.
3. The sales contract is formed when we send an order confirmation or dispatch confirmation, whichever occurs first.
4. We may refuse or cancel an order before dispatch for legitimate reasons, including unavailability, payment failure, suspected fraud, delivery restrictions, legal or regulatory requirements, or an obvious error. Any payment collected for a cancelled order will be refunded.

Products are offered subject to availability. We may limit quantities per person, household, address, payment method or order where reasonably necessary.

6. Payment

Available payment methods are displayed at checkout and may be provided by third-party payment processors. You confirm that you are authorised to use the selected payment method. Payment data is processed securely by the relevant provider; we do not necessarily receive or store complete payment-card details. We may carry out lawful fraud-prevention and payment-verification checks.

7. Delivery

We currently deliver to addresses in Switzerland, the European Union and the United Kingdom, subject to carrier coverage and any restrictions displayed at checkout. Available delivery methods, charges and estimated timeframes are shown before purchase. Delivery dates are estimates unless expressly agreed as binding. Delays may occur due to customs, carriers, weather, peak periods, incorrect addresses or events beyond our reasonable control.

You must provide a complete and accurate delivery address and cooperate with reasonable delivery instructions. Additional costs caused by an incorrect address, an unjustified refusal, or failure to collect a parcel may be charged to you to the extent permitted by law. Risk of loss passes to a consumer when the consumer, or a person designated by the consumer other than the carrier, takes physical possession of the goods, unless mandatory law provides otherwise.

8. Right of withdrawal and returns

Consumers may withdraw from an eligible online purchase within 14 days without giving a reason. For goods, the period begins on the day after the consumer, or a designated third party other than the carrier, receives the goods. This contractual right also applies to eligible orders delivered in Switzerland, without limiting stronger mandatory rights that may apply elsewhere.

To exercise the right, email maeva.ouldbey@lianne-del.com before the deadline with your name, order number, products concerned and an unequivocal statement that you wish to withdraw. We will provide or confirm return instructions. Products must then be sent back without undue delay and no later than 14 days after you notify us.

Return address: Ether Beauty SA / Lianne Del Returns, Corso Garibaldi 50, 20121 Milano, Italy. Please contact customer service before sending any return so that it can be identified and processed. Do not send returns to the registered office in Geneva unless instructed in writing.

You bear the direct cost and risk of returning goods following a change of mind. We recommend a tracked service and proof of postage. You are liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

For health protection and hygiene reasons, the right of withdrawal does not apply to sealed goods that are not suitable for return once unsealed, where the seal has been broken after delivery. This may include opened or unsealed cosmetic and haircare products where they cannot safely be resold. This exception does not affect rights relating to goods that are faulty, damaged, unsafe or not as described.

Where withdrawal is valid, we will refund payments received for the returned products and, where required by applicable law, the cost of the least expensive standard delivery offered for the order. Any premium delivery upgrade is not refundable beyond the standard-delivery amount. We may withhold reimbursement until we receive the goods or evidence that they were sent back, whichever occurs first. Refunds are made using the original payment method unless otherwise agreed, without undue delay and within the applicable statutory deadline.

9. Damaged, faulty or incorrect goods

Inspect the order promptly after delivery. If an item is damaged, faulty, unsafe, incorrect or not as described, contact maeva.ouldbey@lianne-del.com with the order number and, where reasonably useful, photographs. We will provide an appropriate remedy in accordance with applicable law, which may include replacement, repair where suitable, price reduction or refund. We will bear reasonable return costs where the goods are defective or incorrectly supplied. Statutory guarantees and mandatory remedies, including those applicable to consumers in the EU and United Kingdom, are not restricted by these Terms.

10. Promotions and discount codes

Promotions and discount codes are subject to their stated conditions, availability and validity period. Unless expressly stated otherwise, they cannot be combined, exchanged for cash, applied retrospectively or used for resale. We may refuse or cancel misuse, fraud or technical exploitation of a promotion without affecting legitimate consumer rights.

11. Accounts and communications

You are responsible for maintaining the confidentiality of any account credentials and for information submitted through your account. Tell us promptly if you suspect unauthorised use. Transactional communications about orders, delivery, safety or service are necessary to perform the contract. Marketing communications are sent only in accordance with applicable law and may be unsubscribed from at any time.

12. Intellectual property

The Website and its content—including the Lianne Del name, logos, product names, designs, photographs, videos, text, graphics and software—are owned by or licensed to Ether Beauty SA and protected by intellectual-property laws. You may view and make limited personal use of the Website. No content may be copied, reproduced, modified, distributed, exploited commercially or used to train automated systems without prior written permission, except where applicable law expressly permits it.

13. Third-party services and links

The Website may rely on or link to third-party services, including Shopify, payment providers, analytics tools, social platforms and carriers. Their own terms may apply to your direct use of those services. We are not responsible for independent third-party websites or services except to the extent responsibility cannot lawfully be excluded.

14. Reviews and user content

If you submit a review, image, comment or other content, you confirm that it is accurate, lawful, non-infringing and based on a genuine experience. You grant Ether Beauty SA a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for the operation and promotion of Lianne Del, subject to applicable privacy and consumer-review laws. We may moderate or remove unlawful, abusive, misleading or irrelevant content, but we will not suppress genuine reviews merely because they are negative.

15. Privacy

Personal data is processed as described in our Privacy Policy and Cookie Policy, which should be read alongside these Terms. By placing an order, you acknowledge that necessary data will be shared with service providers such as payment processors, Shopify, fulfilment partners and carriers to process and deliver the order.

16. Availability, warranties and liability

We aim to keep the Website available and secure but do not guarantee uninterrupted or error-free access. We may suspend access for maintenance, security, legal or operational reasons. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, business interruption, or loss caused by events beyond our reasonable control arising from non-consumer use of the Website or products.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct or gross negligence where applicable, product liability, or breach of mandatory consumer rights. For consumers, we remain responsible for foreseeable loss caused by our breach of contract or failure to use reasonable care and skill.

17. Events beyond reasonable control

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural events, epidemics, governmental action, customs disruption, war, civil disorder, cyber incidents not caused by our failure to use reasonable safeguards, labour disputes, carrier disruption, or failure of essential networks. We will take reasonable steps to reduce the impact and will inform affected customers where appropriate.

18. Governing law and disputes

These Terms and contracts with Ether Beauty SA are governed by Swiss law. The courts of Geneva, Switzerland, have jurisdiction, subject always to any mandatory consumer-protection rule that permits a consumer to rely on the law or courts of their habitual residence. Before starting formal proceedings, please contact maeva.ouldbey@lianne-del.com so that we can try to resolve the matter directly.

19. General provisions

If any provision is invalid or unenforceable, the remaining provisions continue in effect and the affected provision will apply to the maximum extent permitted. A delay in enforcing a right is not a waiver. We may transfer our rights and obligations where this does not reduce consumer protections; you may transfer yours only with our written consent or where law permits. These Terms, together with the policies referenced at checkout, form the agreement relating to use of the Website and the relevant order.

20. Changes and contact

We may update these Terms for legal, security, operational or service reasons. The version published when an order is placed applies to that order. Material changes affecting Website use take effect when posted or on the stated effective date and do not retroactively reduce accrued rights.
